CONDITIONS OF PARTICIPATION

  1. DURATION OF THE CONTEST

The “Édika” contest (the “Contest”) is held by the Grands Prix Cyclistes de Québec et de Montréal in collaboration with Importations EDIKA Inc. distributor of LELIT brand espresso machines (the “Sponsor”) and takes place in the province of Québec, starting August 28, 2024, at 10:00 a.m. ET, until Sunday, September 15, 2024, at 11:59 p.m. ET (the “Contest Period”). 

  1. CONTEST ORGANIZERS

For the purposes of the Contest, the “Group” consists of the Sponsor, its subsidiaries including, without limitation, its parent, sister and affiliate companies, retailers, franchisees, advertising and promotional agencies, suppliers of materials and services related to this Contest, the GPCQM, partnership, sole proprietorship or other legal entity directly related to the conduct of the Contest, and their respective employees, agents and representatives (the “Group Members”)

  1. ELIGIBILITY

This Contest is open to any person who:

(i) is a resident of the province of Québec;

(ii) is eighteen (18) years of age or older at the time of the contest.

Excluded are affiliates and employees of any company, organization or corporation collaborating in this contest, representatives or agents, advertising and promotional agents, as well as their immediate families and persons with whom they are domiciled.

  1. MODE OF PARTICIPATION

4.1 No purchase necessary;

4.2 To participate, go to the GPCQM x Édika contest webpage to fill out the entry form. You will then have an “Official Entry”.

4.3 There is a limit of one (1) entry per person, per email address, per street address, per telephone number, for the entire duration of the contest. In the event that a person enters, in any way, more than once, his/her entry will be void for the entire Contest Period;

4.4 If the identity of an entrant is disputed, the account holder of the email address used at the time of entry will be determined to be the entrant. The person who has been assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted email address is deemed to be the authorized account holder.

  1. CHANCES OF WINNING

Odds of winning are one per valid entry received.

  1. DRAW

6.1 The winner will be selected by random draw from all valid entries received between August 28, 2024 at 10:00 a.m. ET and September 15, 2024 at 11:59 p.m. ET;

6.2 The draw will be held on Wednesday, September 18, 2024 at 10:00 a.m. ET at the offices of GPCQM,  619 rue le Breton, Longueuil, J4G 1R9

6.3 The winner will be contacted by email within two (2) business days of the draw date. The winner will have four (4) business days following the draw date to claim his/her prize. If the winner cannot be reached after a reasonable number of attempts, he/she will be forfeited, and an alternate winner will be selected by random draw according to these rules. The winner’s name will be available at https://www.facebook.com/GPCQM/.

  1. THE PRIZE

A JURA S8 espresso machine valued at $2,995 offered by Edika.

  1. WARRANTY

The machine comes with a one year warranty offered by the sponsor Edika. The warranty takes effect upon receipt of the prize by the winner.

  1. AWARDING OF PRIZE

In order to be declared a winner, the selected entrant must, in addition to meeting the Contest eligibility requirements and complying with the Official Contest Rules (the “Winner”):

(a) respond to the email message left by the Contest Sponsor or its representatives within two (2) business days of the selection of his/her entry;

  1. b) The winner will be required to sign a standard Declaration and Release form prior to receiving the prize, releasing the Contest Organizers and Sponsors from any liability for any damages that may result from the use of the prize. The winner must provide this document within five (5) days of its submission.

9.1 Disqualification

Failure to comply with each of the conditions set forth in Section 8 above will result in disqualification of the selected entrant and he/she will not be eligible to receive any prize. In such event, the Sponsor reserves the right, in its sole and absolute discretion, to select another entrant as the potential prize winner.

9.2 Prize Possession. 

Upon receipt of the signed Declaration and Release Form from the selected entrants, the Sponsor or its designees will contact the winner to inform him/her of the terms and conditions for taking possession of his/her prize.

  1. GENERAL CONDITIONS

10.1 Verification of Entries

All entries are subject to verification by Sponsor. Any entry that is illegible, incomplete or made in a fraudulent manner will be disqualified. Any entrant or person attempting to enter by any means which is contrary to these Official Contest Rules or which is otherwise disruptive to the operation of this Contest or is otherwise unfair to other entrants or potential entrants will be disqualified. Any decision by the Contest judges, who may be employees or independent organizations, including without limitation any question of eligibility or disqualification of any entry and participation, is final. Entries become the property of the Sponsor and none will be returned.

10.2 Acceptance of Prize

The prize must be accepted as described in these rules and cannot be returned or substituted for another prize, nor exchanged in whole or in part for cash, subject only to the provisions of paragraph 7 above. The prize is not transferable to any other person.

10.3 Prize Substitution

The Sponsor reserves the right, in its sole and absolute discretion, and for any reason whatsoever, to substitute a prize or a portion thereof with a prize of equivalent or greater value, including the cash value of the prize. Winner agrees to abide by the Contest eligibility requirements and these Contest Rules. Participation in the Contest constitutes acceptance and understanding of these Rules.

10.4 Prizes/Winners

10.4.1 By entering this Contest, each entrant acknowledges that under no circumstances will Class Members be required to award more prizes than the number of prizes available as set out in the Official Contest Rules. In the event that for any reason (including, without limitation, due to any error, malfunction or defect in the design, promotion, management, implementation or administration of the Contest, whether mechanical, electronic, human or otherwise), the number of declared winners or the number of prizes claimed by entrants exceeds the number of prizes available, Sponsor reserves the right, in its sole and absolute discretion, to terminate the Contest in whole or in part, without notice, subject only to the prior approval of the Régie des alcools, des courses et des jeux du Québec, if required, in the Province of Québec, and award the appropriate number of prizes from among the appropriate number of winners, selected in accordance with the Contest Rules from among the eligible entries validly submitted prior to the end of the Contest.

10.4.2 The Class Members assume no responsibility whatsoever in any case where their inability to act results from an event or situation beyond their control or from a strike, lockout or any other labour dispute in their establishments or in the establishments of the organizations or companies whose services are used to hold this contest. They reserve the right, in their sole and absolute discretion, to modify, cancel, terminate or suspend the Contest in whole or in part, for any reason or circumstance, including, without limitation, in the event that an event beyond their control corrupts or affects the administration, security, impartiality or normal operation of the Contest, such as a virus, computer bug or unauthorized human intervention, subject to the approval of the Régie des alcools, des courses et des jeux du Québec in the province of Québec.

10.4.3 By entering this Contest, the winner authorizes Class Members to broadcast, publish and otherwise use his/her name, photograph, image, statement regarding the Contest or any prize, place of residence and/or voice for publicity purposes without compensation. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. By entering or attempting to enter this Contest, each entrant and/or purported entrant agrees to release, discharge and hold harmless, forever, the Class Members and their respective directors, officers, employees, shareholders, agents or other representatives (collectively, the “Indemnitees”) from any and all claims, actions, damages, (collectively, the “Indemnitees”) from any and all claims, actions, damages, demands, causes of action, suits, debts, duties, accounts, bonds, agreements, warranties, indemnities, contracts or liabilities of any kind arising out of or in connection with the entrant’s participation or attempted participation in the Contest, compliance with or non-compliance with these Contest Rules, or acceptance and use of the Prize. The Indemnitees will not be liable for lost, incomplete, late or misdirected entries or for any failure of the Contest Website during the Contest Period, or for any technical malfunction or other problems with any telephone network or lines, computer online systems, servers, access providers computer equipment or software or for any other technical problems or traffic congestion on the Internet or at any website, or any combination thereof, and will not be liable for any injury or damage to any person or property resulting from or related to that person’s or any other person’s participation or attempted participation in this Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. No communications or correspondence related to the Contest will be exchanged with entrants, except with the entrant selected as the potential prize winner.

PERSONAL INFORMATION

Personal information collected about entrants in connection with this contest is used solely for the administration of this contest. No communication, commercial or otherwise, unrelated to this contest, will be sent to the entrant by the GPCQM and Edika, unless the entrant has otherwise permitted the GPCQM and/or Edika or its affiliates, as applicable, to do so.
